Acceptance of Terms
By accessing or using the JMedCare Healthcare Management System, you agree to be bound by these Terms of Use. If you do not agree to these Terms, you may not access or use the System.
1. ELIGIBILITY AND ACCOUNT REGISTRATION
1.1 Eligibility
To use the System, you must:
- Be at least 18 years of age
- Be a licensed healthcare professional or authorized staff member
- Have legal authority to bind your Healthcare Facility to these Terms
- Comply with all applicable healthcare regulations and laws
1.2 Account Responsibility
You are responsible for:
- Providing accurate and complete information during registration
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized access
2. ACCEPTABLE USE
2.1 Permitted Uses
You may use the System to:
- Manage patient records and medical information
- Schedule appointments and manage calendars
- Process billing and insurance claims
- Generate reports and analytics
- Communicate with patients and staff
2.2 Prohibited Uses
You may NOT use the System to:
- Violate any local, state, national, or international law
- Engage in fraudulent billing or insurance practices
- Upload viruses, malware, or malicious code
- Attempt to gain unauthorized access to the System
- Access data you are not authorized to view
- Falsify medical records or patient information
- Violate patient privacy rights or regulations
- Use the System to harass, abuse, or harm others
2.3 Compliance with Healthcare Regulations
You must comply with all applicable healthcare regulations, including:
- HIPAA (Health Insurance Portability and Accountability Act)
- GDPR (General Data Protection Regulation)
- HITECH (Health Information Technology for Economic and Clinical Health Act)
- Local medical practice regulations
- Patient consent and privacy requirements
3. USER RESPONSIBILITIES
3.1 Data Accuracy
You are responsible for:
- Ensuring all data entered into the System is accurate and complete
- Verifying patient information before making clinical decisions
- Maintaining professional standards in record-keeping
- Correcting errors or inaccuracies promptly
3.2 Professional Conduct
As a healthcare professional, you must:
- Exercise independent professional judgment
- Not rely solely on the System for clinical decisions
- Maintain patient confidentiality
- Follow established medical protocols and standards
- Document patient care appropriately
4. PATIENT DATA AND PRIVACY
4.1 Data Ownership
You retain ownership of all Customer Data and Patient Data. We do not claim any ownership rights to your data.
4.2 Your Privacy Obligations
You are responsible for:
- Obtaining patient consent for data collection and use
- Providing patients with privacy notices
- Honoring patient rights (access, correction, deletion)
- Complying with data breach notification requirements
- Managing data retention and disposal
4.3 Data Breach Notification
In the event of a data breach:
- We will notify you within 72 hours of discovery
- You must notify affected patients as required by law
- You must report the breach to appropriate authorities
5. BILLING AND PAYMENTS
5.1 Fees and Payment Terms
- Fees are due in advance of each billing period
- Payments are non-refundable except as required by law
- Late payments may result in service suspension
- Subscriptions automatically renew unless cancelled 30 days before renewal
6. DISCLAIMERS AND WARRANTIES
6.1 Medical Disclaimer
THE SYSTEM IS A TOOL TO ASSIST HEALTHCARE PROFESSIONALS. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL JUDGMENT.
You acknowledge that:
- The System does not provide medical advice
- You are solely responsible for clinical decisions
- You must verify all information before acting on it
- The System should not be the sole basis for diagnosis or treatment
6.2 Warranty Disclaimer
THE SYSTEM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or use
- Business interruption or lost opportunities
- Medical malpractice or patient harm
- Regulatory fines or penalties
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless JMedCare from any claims, damages, losses, and expenses arising from:
- Your use or misuse of the System
- Your violation of these Terms or applicable laws
- Medical malpractice or professional negligence
- Unauthorized access to your account
9. TERMINATION
9.1 Termination Rights
We may terminate or suspend your access immediately if you:
- Breach these Terms
- Fail to pay fees
- Are required to do so by law
9.2 Effect of Termination
Upon termination:
- Your access to the System will cease
- You may export your data within 30 days
- Outstanding fees remain due
- After 30 days, data may be permanently deleted
10. DISPUTE RESOLUTION
10.1 Informal Resolution
Before filing a claim, you agree to contact us to resolve the dispute informally through good faith negotiation.
10.2 Arbitration
If informal resolution fails, disputes shall be resolved through binding arbitration.
10.3 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.
11. GENERAL PROVISIONS
11.1 Modifications
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or notice within the System. Continued use after notification constitutes acceptance.
11.2 Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
